The following Terms of Use (“Terms”) are a legal agreement between START COMPANY LLC (“Company”, “we”, “us” or “our”) and you (“User”, “you” or “your”), who use the website located at https://abreshom.com/ and the services offered through this site (“Services”). Please read the Terms carefully; your use of our Services constitutes your acceptance of these Terms.

1. Introduction

1.1. These Terms apply to all Services provided by our Company, including company formation, accounting, tax declaration and other company services abroad.
1.2. Our Services cover various countries such as America, England, Canada, United Arab Emirates, Seychelles, Southern Cyprus, British Virgin Islands, Hong Kong and Singapore.
1.3. The Terms should be evaluated together with the applicable laws and regulations. In the event of any conflict, the provisions of these Terms shall prevail, and the relevant legal regulations shall prevail for the articles that are inconsistent or unenforceable due to legislation.

2. Services

2.1. START COMPANY LLC provides consultancy and application support on company establishment, accounting, tax declaration and similar issues abroad.
2.2. In order to benefit from our services, Users must accept the conditions, tax legislation and legal requirements of the relevant countries.
2.3. The scope and features of the services are as stated in the information announced on our website or provided to you and may be updated from time to time.

2.4. Modification and Suspension of Services

  • The Company has the right to unilaterally change, update or temporarily/permanently suspend the scope and operation of the Services with or without prior notice.
  • In this case, the User cannot claim any compensation or damages from the Company.

2.5. Service Warranty and Scope

  • Company does not warrant that the Services will be uninterrupted, error-free or fully fit for any particular purpose.
  • The Company cannot be held responsible for any direct or indirect damages that may occur due to delays, technical failures or other problems in the provision of services.

3. User Accounts

3.1. You must be at least 18 years old to use the Services.
3.2. User accounts are created through the client panel software and managed via https://abreshom.com/dashboard-page/.
3.3. It is your responsibility to maintain the confidentiality of your account information. You must immediately notify us of any unauthorized use.

3.4. Account Freezing and Cancellation

  • The Company reserves the right to freeze or cancel the User’s account if there is a reasonable suspicion or determination that the User has violated these Terms or applicable legislation.
  • In this case, the User cannot claim any compensation, refund or damages.

3.5. Additional Verification Processes

  • The Company reserves the right to request additional identity verification, documentation or information due to legal obligations or internal policies. Failure to provide the required information may result in the Services being restricted, suspended or terminated.

4. Payment Terms

4.1. All payments must be made in full before the service is provided. Installment option is not offered.
4.2. Accepted payment methods: Visa, Mastercard, American Express, Bank Transfer, Wise and Payoneer.

4.3. Additional Fees and Commissions

  • The user is responsible for any additional fees arising from bank commissions, transaction costs or exchange rates that may arise depending on the payment method he/she prefers and the country he/she is located in.
  • The Company assumes no liability for any additional charges that third party payment providers may charge.

4.4. Price Changes

  • The Company has the right to change the Service fees due to reasons such as market conditions, exchange rates or operational expenses.
  • New prices come into effect after they are announced on the website or other communication channels. By continuing to use the Services, the User is deemed to have accepted these prices.

4.5. Users who benefit from our services are obliged to make payment transactions only with a credit card or bank card registered in their name. If the card used during payment does not match the person receiving the service, our company reserves the right to cancel the transaction and initiate legal action if deemed necessary.

5. Return and Cancellation Policy

5.1. Cancellation Before Service: If the ordered service or company establishment is not started, a full refund will be made upon cancellation request.
5.2. Refund After Service: If the company cannot be established successfully, a 100% refund will be provided.
5.3. Refund Process: Refund requests must be submitted to our customer service team via e-mail or phone. Refund requests will be processed within 5-10 business days.
5.4. Refund Method: Refunds will be made to the original payment method. For refunds made via bank transfer, the user must provide their bank account information.
5.5. Partial Refunds: If a part of the service has been completed and the cancellation request is based on a justified reason, a partial refund may be made; these situations will be evaluated on a case-by-case basis.
5.6. Refund Rejection: Refund requests will not be accepted after the company establishment or other services have been fully provided.
5.7. Disputes: For disputes regarding the return policy, please contact our customer service team first and try to resolve the issue amicably.

5.8. Special Cases and Exceptions

  • If the user fails to fulfill his/her legal obligations (tax, permit, license, etc.), provides false information/documents, or causes unjustified delays, the cancellation or refund request may be rejected.
  • Additional expenses, deductions or penalties incurred as a result of the user’s actions or negligence may be offset against the refund amount.

6. Usage Restrictions

6.1. We do not work with individuals who reside in or are citizens of countries that have sanctions imposed by the United States.
6.2. You are prohibited from using our Services for any illegal purpose or in violation of these Terms.

6.3. Authority to Refuse Transaction

  • If the Company determines that the User’s use of the Services creates a legal or political risk, the Company has the right to unilaterally refuse or stop providing the Service.
  • In this case, the User cannot make any claim from the Company for any damages that may arise.

7. Intellectual Property

7.1. All content on our website and Services is the property of START COMPANY LLC and is protected by applicable copyright laws.
7.2. The User may not copy, reproduce, distribute or use for any other purposes any content without the written permission of the Company.

8. Limitation of Liability

To the fullest extent permitted by applicable law, START COMPANY LLC and its affiliates will not be liable for any damages arising out of or in connection with the use of the Services.

8.1. Exclusion of Consequential Damages

  • The Company shall not be liable for any indirect, incidental or consequential damages, such as loss of profits, business interruption, loss of data or loss of reputation.

8.2. Risks of Non-Recommended Use

  • The User cannot hold the Company responsible for any damages that may arise from risks that may arise from not receiving the necessary legal or financial advice while using the Services.

8.3. Limitation of Liability

  • In any event, the Company’s total liability is limited to the fee paid by the User for the relevant Service.

9.2. The User’s continued use of the Services after the publication of changes shall be deemed to have accepted the updated Terms.

10. Applicable Law and Jurisdiction

13. Tax and Legislative Responsibility

13.1. Users are responsible for their own tax obligations and compliance with the legislation. It is the responsibility of the User to comply with tax and other legal regulations in different countries.
13.2. The Company cannot be held responsible for the accurate and timely submission of tax or other legal declarations by the Users to the relevant institutions.
13.3. The accounting or tax services provided by the Company are based on the information provided by the User. The User undertakes that the information provided is complete and accurate.

13.4. No Guarantee on Results of Services

  • The Company does not guarantee that the services provided (company formation, tax declaration, accounting, etc.) will provide a specific legal status, tax advantages or full compliance with legislation.
  • The user is responsible for making legal and tax assessments regarding his/her field of activity and, when necessary, working with expert advisors.

13.5. User’s Compensation Obligation

  • The User accepts that he/she is responsible for any damage, loss, fine, legal expenses and similar claims that the Company may incur in cases where he/she does not comply with the legislation or violates the Terms.

14. User-Provided Information and Documents

14.1. The User is responsible for the accuracy of all documents and information provided by the User for the establishment of the company or other services.
14.2. The Company cannot be held responsible for any rejection, cancellation, delay or additional costs that may arise due to the provision of incorrect, false or incomplete documents/information.
14.3. The Company may request additional documents or evidence for the verification of its information.

15. Privacy and Data Protection

15.1. The Company protects User data in accordance with the provisions of confidentiality and relevant legislation. Personal data provided by the User is processed for the purpose of performing the Services and managing customer relations.
15.2. Details regarding data processing processes and User rights are specified in our Privacy Policy. Users must read the Privacy Policy before using the Services.

15.3. Data Loss and Security Breaches

  • Although the Company takes reasonable security measures, it is not responsible for data loss or unauthorized access that may occur in unforeseen circumstances such as cyber attacks or server errors.
  • The User is responsible for protecting the account access information. The Company cannot be held responsible for any damages that may occur as a result of third parties obtaining this information.

16. Force Majeure

16.1. In cases beyond the reasonable control of the Company, such as natural disasters, war, riots, strikes, cyber attacks, technical infrastructure problems, government restrictions, the Company may not be able to fulfill its obligations partially or completely.
16.2. Under these circumstances, the Company’s liability is suspended or postponed for a reasonable period of time. In such cases, the User cannot claim compensation or damages from the Company.

17.2. The User accepts that the contact information is current and accurate. The Company is not responsible for any disruptions that may occur due to incorrect or outdated contact information.

18. Transferability

18.2. The User cannot transfer or assign its rights and obligations arising from the Terms without the written consent of the Company.

19. Divisibility

19.1. If any provision of these Terms is held to be invalid, illegal or unenforceable, it will not affect the validity or enforceability of any remaining provisions.
19.2. The invalid or unenforceable provision will be revised or modified to reflect the original intention of the parties and be legally enforceable.

20. Compensation Liability

20.1. The User is responsible for covering any and all direct or indirect claims, including damages, losses, penalties, litigation costs and attorney fees that the Company may incur due to the User’s violation of these Terms or applicable legislation.
20.2. This article does not exclude the Company’s right to seek compensation through litigation or any other method.
